Settlement in teen's alcohol-tied death
A lawsuit filed in August against the owners
of a Sahuarita convenience store by the parents
of a boy who died in an alcohol-related crash
has been settled.
The attorneys on each side of the case, David
Dwyer and Steve Corradini, declined to disclose
the amount of the settlement -- which was reached
earlier this month during mediation.
Kelly and Christina Ott sued 1-Stop Market Inc.
and owners Richard and Bernice Jensen claiming
clerks sold their 17-year-old son Wesley Edward
Ott alcohol when they should have known he was
underage and intoxicated.
Ott was driving a 2006 Chevrolet pickup truck
at high speed when he lost control near McGee
Ranch and White Hills roads, causing the truck
to roll several times, according to Pima County
Sheriff's Department officials.
Ott and Anthony Gonzalez, 19, were thrown from
the truck.
Ott died and Gonzalez was critically injured.
The Otts sought unspecified compensatory and
punitive damages, claiming the defendants' actions
were "negligent and/or reckless, wanton and
intentional."
Dwyer, who represented the Otts, and Corradini,
who represented the Jensens, said the settlement
did not require anyone to admit responsibility.
Dwyer said he thinks everyone involved in the
settlement was "satisfied" with the
result.
Corradini agreed.
"Mr. Jensen was very sad about what occurred
and he felt bad for the family," Corradini
said. "I think he's relieved to have the
lawsuit resolved."
